Agence BnB · Serviced accommodation · Version française
Quotas on furnished rentals, compensation rules, night caps: while residential short-term letting keeps closing down, hotel-style serviced accommodation remains a full, durable planning use — legal year-round short-term rental, Airbnb included. Here is how it works — and how to obtain it.
In French planning law, hotel and tourist accommodation ("hébergement hôtelier et touristique") belongs to the « commerce and service activities » use class, split into two sub-categories:
Choosing which sub-category to target is not cosmetic: it determines the local planning rules that apply, how the case officer reads the file, and how solid the authorisation stays over time. It is one of the first calls we make in our feasibility study.
| Furnished tourist rental | Serviced accommodation | |
|---|---|---|
| Nature of the premises | Housing (residential use) | A commercial planning use in its own right |
| Regime | Residential-use conversion: quotas, compensation, night caps depending on the city | Change of use (change of destination): a planning authorisation, permanent |
| Durability | At the mercy of municipal rules, which are tightening everywhere | Attached to the premises; the asset appreciates and resells with its authorisation |
| Housing removed from the market? | Yes — hence the compensation rules | No (offices/retail) — no compensation required |
It is the organised, legal answer to the gradual closing of the residential Airbnb market: converting floor space that was never housing — offices, retail units — into fully compliant, authorised serviced accommodation.
Through a change of use: a prior declaration when no structural works are involved, a building permit otherwise. The application must demonstrate a credible hospitality project — rooms, services, fire safety, accessibility — and meet the local requirements (planning rules, heritage).
